Think Pacific Virtual Internship - Terms & Conditions

DEFINITIONS AND INTERPRETATION

In these terms and conditions:

“Registration Fee” means the part of the Program Fee that must be paid by you in order to secure your place on the Program. Payment of this fee confirms your agreement to the contract.

Contract” means your acceptance of a quotation for the Services provided by Think Pacific Ltd. This is an agreement binding in law between Think Pacific Ltd and you, incorporating the Terms and Conditions, Payment of the Registration Fee and Program Confirmation.

Program Confirmation” means a confirmation email sent to you once your Registration Fee has been paid and your place has been confirmed.

Services” means the services to be provided by us (including the Virtual Internship) under the Contract, together with any other services which we provide or agree to provide to you.

Terms and Conditions” means the information contained in this document.

Think Pacific” means Think Pacific Ltd, a company registered in England with Registered number 05990751 of 15 Queen Square, Leeds, LS2 8AJ otherwise known as Us, Our or We.

You” means the participant

“Start Date” means the date, agreed upon with you in advance, that the Program begins.

1. OUR SERVICES

1.1 In return for receipt of the Program Fee, we will undertake to provide you with a virtual internship program as detailed in the Virtual Internships web page description or relevant university specific web page (if relevant to your status as a student of that institution).  

1.2 This includes providing you with an appropriate Action Project assignment to complete for a Fijian organisation and providing support to you via recorded webinars, email and telephone calls with Think Pacific staff.   You will not, as standard, communicate directly with the Fijian partner as part of the Virtual Internship.

1.3 We reserve the right to make reasonable changes and/or substitutions to the Services, based on needs of local partners and other factors.

1.4 We will provide a choice of Action Projects from Fijian Organisations for you to choose from, but you agree that the nature of supporting charity projects requires flexibility and we cannot tailor programs to your specific requirements. We do not guarantee a specific company, role, or sector. 

1.5 If, for whatever reason, You do not accept the Action Project and You choose not to participate in the Program, We will give no refund of program fees or any other associated costs.

2. PROGRAM FEE
(Fully-Funded Scholarship Recipients Please Ignore This Section)

2.1 Your Initial registration fee is 95 British Pounds Sterling

2.2 Your remaining balance is due within 21 days before the start date of the Internship.

2.3 You may fund raise up to 50% of the cost of your program directly to our charity, Think Pacific Foundation.  All donations and fundraising are non-refundable in all circumstances

2.4 You are responsible for covering all and any charges imposed by financial institutions, including PayPal fees, foreign transaction fees, and wire transfer fees. This applies to your Registration, Program Fee and any other transfer to us. 

2.5 Some participants may be eligible for a discounted Program Fee – for example, students enrolled in a university with whom Think Pacific has a formal relationship. If a participant is eligible for more than one discount, then Think Pacific has the sole power and discretion to decide how or whether the discounts may be combined, or if only one discount may be applied.

3. ACCURACY OF INFORMATION

3.1 We make every effort to ensure that the information provided to you in respect of your Expedition is accurate. You accept that any information supplied by Think Pacific regarding our Programs, including content published by third party advertisers is given in good faith and correct at the time of going to press. We will not be held liable and do not take responsibility for any misinformation or ambiguities in the content.

3.2 We reserve the right to change our suppliers and the format of our Program as and when necessary, however we will endeavor to provide as similar a program as possible at all times.

 

4. CANCELLATION OR ALTERATION

4.1 If you wish to withdraw from the program at any time, then you must notify Think Pacific by email.

4.2 The Registration Fee, and all subsequent Program Fees paid, are not refundable if you withdraw from the Program for any reason other than Think Pacific’s failure to provide you with a Virtual Internship. This includes withdrawal for medical, personal, family, academic, financial and all other reasons. 

4.3 The Registration and all subsequent Program Fees paid, are refundable ONLY if Think Pacific fails to place you in an internship role.

4.4 If you withdraw from the Program for any reason after being placed in an internship role, The Think Pacific will be entitled to 100% of your Initial Deposit and either 100% of the subsequent payment(s) you made after the Deposit or 50% of the Program Fee, whichever is greater. If the withdrawal takes place less than 21 days before the Commencement Date, Think Pacific will be entitled to 100% of your Initial Deposit and 100% of the Program Fee.

4.5 In the event that, for any reason at all, you decide to discontinue your place on the Program after it has started but before it is due to end, no refund will be given.

4.6 If, for whatever reason, we have to suspend a Program, prior to your start date, you will be entitled to a full refund.

4.7  Any money fund raised for our charity, Think Pacific Foundation, cannot later be refunded to a donor under any circumstances.  Think Pacific Foundation has a duty to put all of the assets towards achieving the organisations charitable objectives.

4.8  If you require any alterations to your booking, including changes to the start date then amendments can be made at the discretion of Think Pacific. We retain the right to charge you an administration charge of £30 to make any amendments to your booking.

5. LIMITATION OF LIABILITY

5.1 We cannot accept any responsibility or liability for loss of or damage to your personal property from undertaking the Virtual Internship.

5.2 We cannot accept any responsibility or liability for program changes or program cancellations under any of the following circumstances; war or threat of war; epidemic or pandemic, terrorism or threat of terrorism; fire; sickness; environmental or climate concerns; acts of government or local authority; or, any other event or circumstance, which amounts to a “force majeure” and in such cases no refund or compensation for any loss will be given to you unless otherwise decided at our sole discretion.

5.3 We take no responsibility and are not liable for any third party behavior or actions including but not limited to that of the host internship Fijian partner and any communication you have with them.

5.4 In all instances, our maximum liability is limited to the Program Fee.

5.5 If any provision of the Agreement (or part of any provision) is found by any court or other authority of competent jurisdiction to be invalid, illegal or unenforceable, that provision or part-provision shall, to the extent required, be deemed not to form part of the Agreement, and the validity and enforceability of the other provisions of the Agreement shall not be affected.

5.6 We reserve the right to amend this document

6. YOUR OBLIGATIONS

6.1 You agree to behave in a respectful, courteous and friendly manner with Think Pacific Program staff, fellow participants, Host Organization representatives and co-workers, and the general public.

6.2 We reserve the right to expel, at our sole discretion, any Participant from the program for reasons including but not limited to: breaking the law; bullying or harassment of other participants; anti-social or unreasonable behavior or unfit conduct towards other group members, our representatives, our suppliers or excessive absence from work. Whether a Participant has acted in any of the ways set out above will be determined by us in our sole discretion. In such instances, we retain the right to immediately remove you from the Program, with no refund issued.

6.3 You are aware that Your Program is strictly unpaid and short term

6.4 You will be required to attend all sessions and complete all tasks required under the program and complete tasks given to you to the best of your ability and in a timely manner

6.5 In instances where the assigned internship Fijian partner organisation demands it, you agree to sign a Non-Disclosure Agreement with the assigned internship provider. Regardless of whether or not the assigned internship provider requires a written Non-Disclosure Agreement, you agree to respect and keep strictly confidential the intellectual property of the host partner.   

6.6 Any work produced by you under the internship for the Fijian partner organisation or Think Pacific including, but not limited to, resources, documents, data, presentations, video footage and audio recordings shall be used at the discretion of the Fijian organisation and Think Pacific. This includes being shared to staff, volunteers, partners, government, future interns or university staff.

7. COMPLAINTS

7.1 Think Pacific aims to provide you with an enjoyable and rewarding program. Should you experience any problems while participating in our Program, you must immediately inform us in writing (by email to info@thinkpacific.com), with a clear explanation of the problem. In such an event, we will discuss the problem with you and will discuss ways in which the problem can be solved. We are not responsible for any conversations or anything that is said unless it is recorded in the written form either by email or by letter.

7.2 If you wish to terminate your placement prior to the end of the time stated in the contract for any reason, you must provide us with written notice, clearly stating the reasons for such a decision. You agree that no refund of the Program Fee or any other fees will be made in this situation, that no other placement will be offered.

8. GOVERNING LAW AND JURISTICTION

8.1 The Contract and any dispute or claim arising out of or in connection with it or its subject matter, shall be governed by, and construed in accordance with, the law of England and Wales.

8.2 The parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with the Contract or its subject matter.
